What is malicious mischief, you ask? Malicious Mischief is a crime that is committed when someone knowingly and maliciously causes physical damage to the property of another. It comes in three degrees, which is often based on the value of the property destroyed. For example, first degree malicious mischief happens when the damage exceeds five thousand dollars. First degree malicious mischief is a Class B felony. Malicious mischief in the second degree is a Class C felony and includes damage to the property of another in an amount exceeding seven hundred fifty dollars. Finally, malicious mischief in the third degree is a gross misdemeanor and includes acts that are done knowingly and maliciously that cause physical damage to the property of another, under circumstances not amounting to malicious mischief in the first or second degree.
