California recently enacted sweeping gun control laws. Can Washington be far behind? As they say, time will tell.
California’s new gun control laws will restrict access to weapons, and will create an avenue for private citizens to sue the gun industry via Assembly Bill 1594, which established a ‘firearm industry standard of conduct,’ and allows local governments, the State Department of Justice and gun violence survivors to sue manufacturers and dealers for egregious violations of state sales and marketing regulations.
Assembly Bill 1594, although broad, was drafted with some outlier protections for manufacturers and dealers, which have been provided at least some minimal levels of safety from frivolous lawsuits. The majority of California’s gun law will go into effect on July 1, 2023, but some aspects will be implemented immediately so long as the law falls under a California urgency exception. The gun laws come less than a month after the US Supreme Court ruled against restrictions on carrying firearms in public, a substantial victory for Second Amendment Rights advocates.
