Sharing revenge porn soon to be criminalized under the ‘Take It Down Act.’ On Monday the House passed bipartisan legislation to criminalize nonconsensual sharing of sexually explicit photos and/ or videos of others, including, without limitation, AI generated images, commonly known as ‘deep fakes’. If notified, the offending platform (i.e. social media companies and/or online entities such as X, Instagram, Tik Tok and Meta) will be required to quickly remove the offending pictures and/or videos within 2 days. President Trump will most assuredly quickly sign the bill into law. The legislation is aimed at fighting online sex trafficking, harmful online content and outright disinformation, as well as regulating internet companies from evading government scrutiny. Some argue this bill impedes free speech and has dangerous implications for privacy online. For now, those concerns appear to have been trumped by the Take It Down Act.
