On Monday the United States Supreme Court again reiterated what it had said just two short months ago – while appeals rage, President Biden’s administration can continue to regulate ‘ghost guns,’ which are basically kits that can be bought online and assembled into untraceable homemade firearms. The high court’s order shuts down at least two lower court’s positions to the contrary, notwithstanding the justices’ earlier decision. By restating its earlier ruling, it appears the high court was rebuking the lower courts, essentially ‘putting them in their place’. The regulation at issue did not ban the sale or possession of kits and components that can be assembled to make guns, but it did require manufacturers and sellers of those kits to obtain licenses, mark their products with serial numbers and conduct background checks prior to sale.
