Earlier this week, President Trump signed an executive order intended to eliminate cashless bail. Proponents of cashless bail claim that removing the policy unfairly disadvantages the poor because cashless bail allows defendants to get out of custody without posting money when they face lesser charges. Some argue the practice of cashless bail creates public safety concerns because it allows accused criminals back out on the streets uninhibited and unfettered. The executive order signed by President Trump instructs the United States Attorney General to identify which states have substantially eliminated cash bail within 30 days. Once identified, certain federal funds may be suspended for those jurisdictions. At least that appears to be the plan.
