Although not on the topic of criminal defense, it is still a point of topical interest – a federal judge blocked Oregon’s ban on homebuyer ‘lover letters,’ as it potentially infringes upon first amendment protections. What is a homebuyer lover letter? It is a letter or a note that a potential homebuyer writes to a seller expressing why she should be sold the house even though her offer may not monetarily be the best. The ban was instituted by the Oregon Legislature in an effort to limit housing discrimination. It hoped to quash sellers from making decisions based on race, national origin, marital or family status, sexual orientation or other protected classes. Obviously, on its face, the goal was laudable. However, infringing on free speech isn’t acceptable either. The court, in short, noted the goal can be met without impacting other constitutional protections. Back to the drawing board, as they say … no doubt this is a huge issue when one considers how volatile the housing market is around the country, and especially the northwest. Everyone just wants a fair shake, and that isn’t an unreasonable desire is it?
