The patrol sergeant – Scott Moss – told the arresting state patrol trooper that he hadn’t consumed alcohol for five hours before
being pulled over. He had spent the evening in Bremerton and was asleep just before a friend dropped him off at his car around 5 a.m. the morning of the alleged incident. Mr. Moss was stopped because his vehicle allegedly drifted onto the freeway’s shoulder. During the trooper’s contact with Mr. Moss, he smelled alcohol about Mr. Moss. Mr. Moss was subsequently arrested for DUI and taken to a police precinct where he submitted to an analysis of his breath. His BAC results were measured at .069 and .075, respectively; both results were below Washington’s legal per se limit of .08. Apparently Mr. Moss questioned why he was being processed for DUI when his BAC was below the legal limit. The arresting trooper’s supervisor intimated that it was because by doing the math it was clear to see that Mr. Moss was over the legal limit at the time of the stop. A Seattle Police Department internal investigation has been launched into the matter.
